IMPORTANT: By using our website, making a booking, or participating in any Set Wild event, you agree to these Terms of Service in full. If you do not agree to these terms, please do not use our services.

1. Agreement to Terms

By accessing our website, making a booking, or participating in any Set Wild adventure event, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These terms constitute a legally binding agreement between you and Vespera Holidays LTD.

For Event Participants: In addition to these general terms, participants in adventure events are required to sign our Event Participation Agreement at the event. These Terms of Service should be read in conjunction with that agreement.

2. Services Provided

2.1 Adventure Weekends

Set Wild offers outdoor adventure events featuring activities such as hiking, wild swimming, paddleboarding, yoga, sauna, cold plunge, soundbath, cooking, and other outdoor pursuits.

Format: Half-board with breakfast and dinner included
Accommodation: Luxury campervans and boho bell tents
Target Audience: Initially women-only events, expanding to mixed events
Activities: May vary by event - specific details provided in booking confirmation

3. Bookings and Payments

3.1 Making a Booking

To make a booking, you must:

  • Be at least 18 years of age

  • Provide accurate and complete information

  • Have authority to make the booking (including for any other participants)

  • Accept these Terms of Service

3.2 Booking Confirmation

Your booking is confirmed when:

  • You receive a confirmation email from us

  • Payment has been processed successfully

  • We have confirmed availability

We reserve the right to decline any booking at our discretion.

3.3 Payment

  • Full payment is required at time of booking unless otherwise agreed

  • Payments are processed securely through Stripe or our booking platform

  • All prices are in GBP (£) and include VAT where applicable

  • You are responsible for any bank charges or currency conversion fees

3.4 Pricing

  • Prices are subject to change but confirmed bookings will honor the price paid

  • Discounts (including referral discounts) cannot be combined unless explicitly stated

  • Additional charges may apply for optional add-ons or activities

4. Cancellation and Refund Policy

4.1 Cancellation by You

All bookings are non-refundable.

Once you have made a booking and payment has been processed, no refunds will be provided for:

  • Cancellations for any reason

  • Changes of mind

  • Inability to attend

  • Personal emergencies

  • Illness or injury

  • Travel disruptions

  • No-shows

We strongly recommend purchasing appropriate travel and cancellation insurance to protect yourself against unforeseen circumstances.

4.2 Transferring Your Booking

If you cannot attend, you may transfer your booking to another person, subject to:

  • Written notice to Set Wild at least 7 days before the event

  • The replacement participant meeting all eligibility requirements

  • The replacement participant accepting these Terms of Service

  • An administration fee of £25

4.3 Cancellation by Set Wild

We may cancel your event if:

  • Extreme weather conditions make activities unsafe (storms, flooding, high winds, extreme temperatures, lightning risk, unsafe water conditions, etc.)

  • Natural disasters or public health emergencies

  • Insufficient participants (minimum numbers not met)

  • Circumstances beyond our control (force majeure)

  • Equipment failure that cannot be resolved

  • Venue unavailability

  • You fail to meet participation requirements (medical, age, eligibility)

In the event Set Wild cancels:

You will be offered the choice of:

  • Full refund of the event fee paid, OR

  • Credit towards a future Set Wild event of equal or greater value, OR

  • Rescheduling to an alternative date (subject to availability)

4.4 What We Are NOT Liable For

If Set Wild cancels your event, we are not liable for:

  • Travel expenses you have incurred (flights, trains, fuel, etc.)

  • Accommodation costs booked separately

  • Time off work or loss of earnings

  • Any other consequential losses

This is why we recommend travel insurance.

4.5 Event Modifications

Where weather or conditions require modification of planned activities (rather than full cancellation), Set Wild may substitute alternative activities where possible.

No refund will be due for:

  • Modified or substituted activities

  • Activities shortened due to weather

  • Changes to the event schedule or itinerary

Unless the event is substantially different from that advertised, in which case we'll discuss options with you.

5. Assumption of Risk and Participant Responsibilities

5.1 Inherent Risks

By booking adventure events with Set Wild, you acknowledge and accept that outdoor activities carry inherent risks including but not limited to:

  • Physical injury or illness

  • Adverse weather conditions

  • Hypothermia, fatigue, or dehydration

  • Slips, trips, and falls

  • Encounters with wildlife

  • Water-based hazards (drowning, cold water shock, etc.)

  • Equipment failure

  • In extreme cases, serious injury or death

5.2 Your Responsibilities

You agree that:

  1. You are voluntarily participating with full knowledge of the risks

  2. You are physically fit to participate in the activities booked

  3. You will follow all safety instructions provided by Set Wild staff and leaders

  4. You are responsible for your own safety and for making appropriate decisions based on your abilities

  5. You will inform staff immediately if you feel unwell or unable to continue

  6. You have disclosed all relevant medical conditions that may affect your participation

  7. You will not participate under the influence of alcohol or drugs that impair judgment

5.3 Age Requirements

  • Participants must be 18+ unless accompanied by a parent/guardian

  • For family events, parents/guardians are responsible for supervising their children at all times

  • Specific activities may have minimum age requirements as stated in the booking

5.4 Medical Conditions

You must disclose:

  • Any medical conditions that may affect participation

  • Current medications

  • Allergies (including food allergies)

  • Physical limitations or injuries

  • Pregnancy

  • Mental health conditions that may be relevant

Failure to disclose relevant medical information may result in exclusion from activities without refund and may affect our ability to assist you in an emergency.

6. Limitation of Liability

6.1 Our Liability

To the fullest extent permitted by law:

  1. Set Wild is not liable for injury, loss, or damage arising from your participation in activities, except where caused by our proven negligence or breach of statutory duty

  2. We are not liable for loss or damage to personal belongings

  3. We are not liable for consequential losses including travel expenses, loss of earnings, or disappointment

  4. Our maximum liability for any claim shall not exceed the total amount paid by you for the booking in question

6.2 Exceptions

Nothing in these terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded by law

6.3 Force Majeure

We are not liable for failure to perform our obligations where such failure is caused by circumstances beyond our reasonable control, including but not limited to: extreme weather, natural disasters, pandemics, government restrictions, terrorism, or civil unrest.

7. Photography, Video, and Media

7.1 Grant of Rights

By participating in Set Wild events, you grant Set Wild:

  1. Permission to photograph, film, and record you during activities

  2. The right to use such media in marketing, social media, website content, promotional materials, advertisements, and other business purposes

  3. Worldwide, perpetual, royalty-free license to use, reproduce, modify, and publish your likeness, voice, and statements

  4. Permission for third parties working with Set Wild (photographers, videographers, influencer partners) to capture and use such media

7.2 No Compensation

You acknowledge that:

  • No payment, royalties, or compensation will be provided for use of your image

  • You will not have approval rights over the final content

  • Set Wild may use the media indefinitely

7.3 Opt-Out Requests

If you do not wish to be photographed or filmed:

  • Inform Set Wild staff at the beginning of the event

  • We will make reasonable efforts to accommodate your request where practical

  • Some activities may be photographed extensively, and complete exclusion may not be possible

8. Code of Conduct

To ensure a safe and enjoyable experience for all participants, you agree to:

8.1 Respectful Behavior

  • Treat all participants, staff, and members of the public with respect

  • Refrain from discriminatory, harassing, or offensive behavior

  • Follow instructions from Set Wild staff promptly, particularly regarding safety

  • Not disrupt other participants' enjoyment

8.2 Safety Compliance

  • Follow all safety instructions and guidelines

  • Use equipment only as instructed

  • Report any safety concerns immediately

  • Not take unnecessary risks

8.3 Environmental Responsibility

  • Respect the environment and wildlife

  • Follow Leave No Trace principles

  • Respect private property and local communities

8.4 Substance Policy

  • Do not attend events under the influence of alcohol or recreational drugs

  • Alcohol may be provided at certain evening social events but excessive consumption is prohibited

  • Prescription medications are permitted if disclosed on your booking form

8.5 Removal from Events

Set Wild reserves the right to remove any participant whose behavior is deemed:

  • Unsafe to themselves or others

  • Disruptive or offensive

  • In violation of this Code of Conduct

  • Under the influence of alcohol or drugs

No refund will be provided in such cases, and you may be liable for additional costs incurred.

9. Equipment and Property

9.1 Set Wild Equipment

All equipment provided (paddleboards, camping equipment, activity gear, etc.) remains the property of Set Wild.

You agree to:

  • Use equipment only as instructed and for its intended purpose

  • Take reasonable care of equipment

  • Report any damage immediately

  • Not lend equipment to third parties

  • Return equipment in the same condition as received (allowing for normal wear)

9.2 Damage and Loss

You are liable for:

  • Loss or theft of equipment while in your possession

  • Damage caused by misuse, negligence, or failure to follow instructions

  • Cleaning costs for excessive dirt or damage

  • Full replacement cost for lost or irreparably damaged equipment

9.3 Personal Belongings

Set Wild is not responsible for loss, theft, or damage to personal belongings. We recommend:

  • Not bringing valuable items

  • Securing belongings at all times

  • Arranging personal insurance for valuables

10. Insurance

10.1 Our Insurance

Set Wild holds:

  • Public Liability Insurance

  • Equipment insurance

  • Event insurance

10.2 Your Insurance Responsibility

IMPORTANT: Because all bookings are non-refundable, we strongly recommend you arrange:

  • Cancellation insurance - To protect against inability to attend

  • Travel insurance - To cover travel disruptions

  • Personal accident insurance - For injury or illness

  • Medical insurance - For medical expenses

Set Wild's insurance does not cover:

  • Your cancellation for any reason

  • Your personal medical expenses

  • Loss or damage to your personal belongings

  • Travel expenses if we cancel the event

  • Claims arising from your own negligence

Purchasing appropriate insurance is your responsibility and we strongly advise doing so given our no-refund policy.

11. Health and Medical Information

11.1 Disclosure Requirements

You must provide accurate information about:

  • Medical conditions

  • Allergies (including food allergies)

  • Current medications

  • Physical limitations

  • Mental health conditions that may affect participation

  • Pregnancy

11.2 Changes to Health Status

You must inform us immediately if your health status changes between booking and participation.

11.3 Emergency Medical Treatment

In the event you are unable to give consent due to incapacitation, you authorize Set Wild staff to:

  • Arrange emergency medical treatment on your behalf

  • Share relevant medical information with emergency services and healthcare providers

  • Make necessary decisions to protect your wellbeing

11.4 Medical Costs

You are responsible for all medical costs arising from illness or injury during events, except where caused by our proven negligence.

12. Data Protection and Privacy

12.1 How We Use Your Data

We collect and process your personal data in accordance with UK GDPR and our Privacy Policy.

Data we collect:

  • Contact details (name, email, phone, address)

  • Emergency contact information

  • Health and medical information

  • Dietary requirements

13. Referral Programme

13.1 How It Works

When you book with Set Wild, you receive a unique referral code starting with "SETWILD-".

When someone uses your code:

  • They receive £25 off their booking

  • You receive £25 refunded to your original payment method

  • Both discounts apply to bookings over £100

13.2 Terms and Conditions

  1. Referral codes are non-transferable and personal to you

  2. You cannot use your own referral code

  3. Only one referral code per booking

  4. Refunds processed within 30 days of the referee's booking completion

  5. Minimum booking value: £100

  6. Set Wild reserves the right to void fraudulent or abusive referrals

  7. The programme may be modified or terminated at any time with notice

13.3 Data Processing

By participating in the referral programme:

  • We record your referral code usage

  • We share the referee's email with you for tracking purposes only

  • We process refunds to your original payment method

20. Acceptance of Terms

If you do not agree to these terms, you must not use our services.

For Event Participants: You will be required to sign our Event Participation Agreement at the event, which includes additional specific terms regarding adventure activities, assumption of risk, and emergency medical authorization.
